These Terms of Use ("Terms") govern your access to and use of the WeatherAI™ website, applications, data, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
By using the Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. We may update these Terms from time to time; your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
Weather forecasts, alerts, radar, air quality figures, and all other information provided through the Service are predictive and inherently uncertain. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, completeness, reliability, merchantability, fitness for a particular purpose, or non-infringement.
WeatherAI™ does not guarantee that any forecast or alert is accurate, timely, or complete. You should never rely on the Service as your sole source of information for decisions affecting safety of life or property. In severe or life-threatening weather, always follow official guidance from your local National Weather Service office and emergency management authorities.
You assume all responsibility for how you use the Service and any information obtained from it. To the fullest extent permitted by law, WeatherAI™, its owners, affiliates, officers, employees, and data providers shall not be liable for any decision made or action taken in reliance on the Service, nor for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages — including, without limitation, loss of life, personal injury, property damage, lost profits, or business interruption — arising out of or relating to your use of, or inability to use, the Service, even if advised of the possibility of such damages.
The Service, including all software, source code, data compilations, forecasts, model outputs, text, graphics, layouts, designs, logos, and other content (the "WeatherAI Materials"), is owned by WeatherAI™ or its licensors and is protected by copyright, trademark, trade secret, and other intellectual property laws. All rights not expressly granted to you are reserved.
"WeatherAI", the WeatherAI™ name, logo, and associated marks are trademarks of WeatherAI™. You may not use these marks without our prior written permission. Nothing in these Terms grants you any right, title, or interest in the WeatherAI Materials or trademarks.
You agree that you will not, and will not permit any third party to:
If the Service permits you to submit, upload, or post any content ("User Content"), you represent and warrant that you own or otherwise control all rights necessary to submit that User Content and that doing so does not violate the rights of any third party or any applicable law.
You retain ownership of your User Content. By submitting User Content, you grant WeatherAI™ a worldwide, non-exclusive, royalty-free, transferable, sublicensable, perpetual, and irrevocable license to use, host, store, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in connection with operating, providing, and promoting the Service. You are solely responsible for your User Content and for ensuring you have the rights to grant this license.
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Provisions that by their nature should survive termination — including intellectual property, limitation of liability, and governing law — will survive.
These Terms and any dispute arising out of or relating to them or the Service shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict-of-laws principles. You agree that the exclusive jurisdiction and venue for any dispute shall lie in the state and federal courts located in the State of Louisiana, and you consent to the personal jurisdiction of those courts.
If any provision of these Terms is found to be unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and WeatherAI™ regarding the Service.
